Terms and Conditions of Sale

These Terms and Conditions of Sale (“Terms”) apply to all purchases made through Nelsons CNC Pty Ltd (“Nelsons CNC”, “we”, “our”, or “us”).

By purchasing products from this website, the customer (“Customer”, “you”, or “your”) agrees to be bound by these Terms.

1. Commercial Use

Our products are designed primarily for trade, fabrication, commercial, and industrial applications. Customers are responsible for independently assessing the suitability of products for their intended application, installation method, and environment.

Products sold by Nelsons CNC Pty Ltd are manufactured by Nelsons CNC Pty Ltd and are supplied as component products only. They are not represented as engineered systems, certified structural components, or safety devices.

2. Product Information and Intended Use

Nelsons CNC aluminium end caps are designed for use with compatible aluminium extrusions and tubing in static applications including, but not limited to:

aluminium fencing, balustrades, handrails, facades, pergolas, gates and architectural fabrication projects. 

Products are designed for a secure interference fit when correctly specified and properly installed into compatible aluminium profiles.

Fitment performance depends on factors including:
- extrusion tolerances
- wall thickness
- corner radius
- installation method
- environmental conditions
- application design

Customers are solely responsible for confirming compatibility prior to installation.

Products are not intended for:
- moving or vibrational applications including motor vehicles, trailers, caravans and boats
- structural load-bearing purposes
- safety-critical retention applications
- use with incompatible materials including steel. 
- applications where failure could result in injury, death, or property damage without independent engineering review

3. Installation


Installation must be performed by suitably qualified fabricators, installers, or trade professionals using appropriate installation methods and tooling. 

General installation guidance:

a. Confirm the correct profile size prior to installation
b. Position the bevelled edge correctly.
c. Install using a rubber mallet or suitable non-damaging installation method.
d. Confirm the end cap is securely seated after installation.

Customers must independently assess whether additional retention methods, mechanical fixing, adhesives, engineering certification, or ongoing maintenance are required for the intended application.

4. Fitment and Tolerances

To achieve the intended interference fit, the following conditions should be met
Products are designed for interference-fit installation into compatible aluminium extrusions and tubing. Products must be matched to the correct profile dimensions, wall thickness, and corner radius specifications prior to installation.
Aluminium extrusions and tubing should have clean, properly prepared edges before installation. Products are designed to achieve a secure and long-term friction fit when correctly specified and properly installed Products are intended for static (non-vibrational) applications only. Products must never be glued. They are designed to achieve retention through interference fitment when correctly specified and properly installed. Surface coatings including powder coating, anodising, paint, timber-look finishes, or other finishes may affect fitment tolerances. Aluminium extrusion tolerances may vary between manufacturers, suppliers, and batches, which may affect fitment performance. Products should be installed using appropriate non-damaging tools, including a rubber mallet where applicable. Products should not be excessively forced, modified, machined, sanded, or altered during installation. If a product appears excessively loose or excessively tight, installation should not proceed until compatibility has been confirmed. Customers are responsible for independently assessing whether additional fixing methods, mechanical fastening, engineering review, inspection schedules, or maintenance procedures are required for the intended application. Environmental conditions, vibration, movement, structural movement, thermal expansion, substrate variation, and application design may affect long-term fitment performance. Products should be inspected after installation and periodically maintained as appropriate for the installation environment. If fitment concerns arise, customers should contact Nelsons CNC Pty Ltd prior to installation or modification of the product.

5. Orders and Acceptance

All orders are subject to acceptance and product availability.
We reserve the right to:
- refuse or cancel orders
- limit quantities
- correct pricing errors
- discontinue products without notice

Prices are listed in AUD unless otherwise stated. Payment is required at checkout unless otherwise agreed in writing.

6. Shipping and Delivery

Estimated shipping timeframes are provided as general guidance only and are not guaranteed.

Risk of loss or damage passes to the Customer upon delivery to the nominated shipping address or carrier.

Customers are responsible for inspecting shipments upon arrival and notifying us promptly of any transit damage or shortages.

Nelsons CNC Pty Ltd is not liable for shipping delays, carrier issues, customs delays, or events outside our reasonable control.

7. Returns and Refunds

We offer a 60-day return policy from the date of delivery.

To be eligible for a return:
items must be unused and in original condition
proof of purchase is required
return authorisation must be obtained prior to return shipment

Custom-machined, special-order, modified, clearance, or non-stock items may not be eligible for return.

Unauthorised returns may be refused.

8. Warranty

Nelsons CNC Pty Ltd provides a 12-month warranty against manufacturing defects from the date of purchase, to the extent required under Australian Consumer Law.

This warranty does not cover:
incorrect installation
misuse or abuse
modification of products
incompatible applications
wear and tear
environmental damage
failure resulting from movement, vibration, or structural application

Customers are responsible for independently assessing the suitability of products for their intended use and application.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under Australian Consumer Law.

9. Limitation of Liability

To the maximum extent permitted by law, Nelsons CNC Pty Ltd shall not be liable for:
indirect damages
- consequential damages
- incidental damages
- loss of profits
- project delays
- installation costs
- removal costs
- third-party claims
- personal injury
- property damage
- misuse or improper installation

Customers assume full responsibility for:
- installation methods
- engineering review
- code compliance
- project suitability
- ongoing inspection and maintenance

Nelsons CNC Pty Ltd’s total liability for any claim relating to a product shall not exceed the purchase price paid for that product.

10. Intellectual Property

All website content including:
- product photography
- renders
- graphics
- logos
- product descriptions
- technical information
- videos
- website copy

remains the property of Nelsons CNC Pty Ltd unless otherwise stated. Unauthorised reproduction, copying, distribution, or commercial use is prohibited without prior written permission.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from purchases or use of this website shall be resolved in the courts of Queensland, Australia.

12. Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. The version published on the website at the time of purchase applies to the order.
